By this application the applicant, apprehending his arrest in connection with investigation of Crime No. 808 of 2021 of police station Wakad, Pune under section 143, 452, 147, 149, 323, 504, 506 and 427 of Indian Penal Code is seeking Anticipatory Bail. 2.

I have heard the learned counsel for the applicant and learned APP for the State. Perused FIR.

Prima facie, the FIR appears to be the outcome of a dispute between the landlord and the tenant. The learned counsel for the applicant, on instructions, states that the possession of the tenanted premises, has not been obtained. He states that the complainant-

tenant continues to be in possession of the said tenated premises. The applicant has no intention to interfere with the possession of the tenant over the said premises.

In view of said statement, the learned APP submitted that, this Court may pass appropriate order as may be deemed, just and necessary.

Hence, following order:

ORDER

i) In the event of his arrest, in connection with the investigation of Crime No. 808 of 2021 registered with Wakad Police Station, the applicant shall be released on bail on executing a PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

ii) The applicant shall attend the investigating officer on 17.01.2022, 18.01.2022 and 19.01.2022 between 11.00a.m. to 1.00p.m. and as and when required and shall co-operate with the Investigating Agency.

iii) The applicant shall not make any attempt to interfere with the possession of the tenanted property otherwise than in due course of law.

iv) In the event of breach of any of the conditions, the

bail is liable to be cancelled.

v) The Anticipatory Bail Application is disposed of in the above terms.
