Learned counsel for the appellant submits that inadvertently this Appeal from Order came to be filed and hence she seeks leave to withdraw this Appeal with liberty to file appropriate proceedings. 22 February 2023

Accordingly, Appeal from Order is allowed to be withdrawn with liberty as prayed for.

Needless to observe that as the appellant was bonafide pursuing the present proceeding, the appellant would be entitled to take a plea in relation to the pendency of the present proceedings, in the event an issue of limitation arises in the proposed proceedings intended to be filed by the appellant. 7.

Disposed of in the above terms. No costs.

In view of disposal of Appeal from Order, Interim Application would not survive. It is accordingly disposed of.
