...Respondent

-------------------- Ms. Gauri Velankar a/w Adv. Mandar Limaye for the Petitioner. --------------------- CORAM : SHARMILA U. DESHMUKH, J.

DATE : DECEMBER 1, 2023 P. C. :

1.

By the impugned order dated 15th June, 2018, the Family Court Thane has decided the Darkhast Application filed by the Petitioner for reimbursement of the education expenses of the children as per the Consent Terms dated 18th September, 2011 executed between the parties whereby the Respondent had undertaken to pay all the necessary educational expenses of the children i.e. one son and daughter. The Petition is of the year 2018 and no steps were taken for obtaining any relief in the Petition. The time gap of about five years has altered the situation, inasmuch as children have completed their education in respect of which the expenses were sought.

23-WP-14597-2018.doc 2.

In view of the above, I am not inclined to interfere with the impugned order. This Court is informed that an application below Exhibit 64 is pending before the Family Court Thane which according to the learned counsel for the Petitioner, has not been decided in totality. 3.

The Family Court, Thane is requested to decide the application below Exhibit 64 expeditiously, if not yet decided. Writ Petition stands dismissed.
