The delay in filing the second appeal is of 80 days. Perused the application. Sufficient cause is made out. As regard the Respondents against whom the application is abated, the learned counsel for the Applicant states that they are not necessary for an adjudication. The civil application is allowed in terms of prayer clause (a). The effect of dismissal of the Application as against some of the Respondents, as stated, is kept open to be considered in the appeal.
