CORAM :

A. M. THIPSAY J.

DATED :

13TH JANUARY, 2015 P.C.

1.

Heard the learned counsel for the applicant.

2.

The learned Additional Public Prosecutor files a report as directed by the order dated 6th January, 2015. The report is taken on record. It shows that the applicant - Jagdish was released on parole, but he did not surrender himself after the period of parole was over. He was required to be arrested and brought to the prison.

8.APPANo.15682013 3.

In view of this report and since the possibility of the appeal itself being expeditiously heard was discussed, the learned counsel for the applicant states that he would not press the present bail application for the time being. He submits that if, however, the appeal cannot be expeditiously heard, he may be permitted to renew the prayer for bail.

4.

This appears to be reasonable.

5.

In the circumstances, it is directed that the appeal be listed for final hearing on 12th February, 2015. 6.

The application is allowed to be withdrawn and stands dismissed as such, with liberty to the applicant to renew the prayer for bail, if, for certain reason, the appeal cannot be heard and finally disposed of within a reasonable time after 12th February, 2015.
