The Applicant apprehending his arrest in connection with the investigation of Crime No.585 of 2021 registered with Daund Police Station, Pune under Section 120B, 417, 418, 419, 420, 465, 468, 469, 471, 473, 475 and 406 read with Section 34 of the Indian Penal Code is seeking anticipatory bail. 2.

The Applicant is a teacher in a High School without any Criminal antecedents.

The prosecution case as per the complaint lodged by Kewal Dattatray Kamble, is that one Sagar Ghode had introduced the present Applicant to him and both of them had assured the N.S. Kamble page 1 of 3

complainant that they can arrange a loan of Rs.5 lakhs to the complainant from the Micro Finance Entity. It is alleged that an amount of Rs.50,000/- was transferred to the account of Sagar Ghode on 22 February 2020 as processing fee. However, the loan did not come through.

Be that as it may, it transpired during the course of the hearing that only an amount of Rs.34,000/- is transferred in the account of the present Applicant. The learned counsel for the Applicant submitted that the Applicant herself is a victim in the incident.

The learned Additional Public Prosecutor on instructions from the Investigating Officer states that the interrogation of the Applicant is necessary for which her presences is required.

In such circumstances, in my considered view the Application can be disposed of by imposing conditions on the Applicant. Hence the following order.

ORDER

(i) In the event of her arrest in connection with investigation of Crime No.585 of 2021 registered with Daund Police Station, the applicant shall be N.S. Kamble page 2 of 3

released on bail on executing a P.R. Bond in the sum of Rs.25,000/-with one or two solvent sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station on 24 and 25 January 2022 between 11.00 a.m to 1.00 p.m. and as and when required. (iii) The Applicant shall co-operate with Investigating Officer and shall not tamper with the prosecution evidence/witnesses.

(v) The Criminal Application is disposed of in the aforesaid terms.
