The above Civil Application has been filed for restoration of the Civil Revision Application No.296 of 2011 which has stood dismissed for non-prosecution on 23.11.2011. The Civil Application has been filed on 01.12.2011 and therefore is in time. The Learned Counsel Shri. Sameer R. Bhalekar appearing of the Respondent No.1 opposes the Civil Application but ultimately leaves it to this Court. The Civil Application is accordingly allowed. Resultantly, the Civil Revision Application is restored to file. Since the above Civil Application has been restored by virtue of the order passed today in Civil Application No.173 of 2016, it would be just and proper to direct the Applicants to pay costs of Rs.1000/- to be deposited with the Kirtikar Law Library, High Court, Bombay within two weeks from date and evidence in that respect to be filed in the BGP.
