The petitioner was lodged in Central Prison Yerawada on transfer from Taloja Central Prison on 16th December, 2012 and was suffering punishment awarded by learned Special Judge in MCOC Special Case No.07/2008 @16 of 2008 @3 of 2009. The petitioner had approached this Court raising a grievance of refusal of special remission. During the pendency of the petition, the petitioner completed the entire term of sentence and with the benefit of remission was released from prison on 1st December, 2022. Learned APP has tendered a copy of the report/communication dated 9th March, 2022, received from Superintendent of Jail, Yerawada Central Prison, Pune. In view of these facts, the petition has been rendered infructuous, as such, learned counsel for the petitioner prayed for leave to withdraw the petition. Leave as prayed for, is granted. The writ petition is disposed of as withdrawn.
