Learned APP has placed on record statement of the victim under Section 164 of the Cr.P.C. recorded by the Metropolitan Magistrate, 18th Court, Girgaon, Mumbai on 09.09.2000 coupled with the report of the Forensic Science Laboratory, Kalina as regards the DNA extract of the victim, which reveals that the applicant is the father of the newly born child. The same is taken on record and marked "X" for identification.

Learned Counsel for the applicant seeks to withdraw the application when this Court expressed its disinclination to grant bail to the accused - applicant.

The application stands dismissed as withdrawn. 4.

The trial Court is directed to frame a charge and shall expedite the hearing of the case at the earliest in view of long incarceration of the applicant.
