The petition arises out of order passed on an application for injunction restraining defendant from creating third parity's rights in a suit for partition.

Considering the nature of relief granted by the Appellate Court, learned Advocate for the petitioners states that the grievance of the petitioner would be satisfied, if the Trial Court is directed to decide the suit within time bound programme. 3.

Considering the nature of suit, the Trial Court is directed to decide the suit within one year from today.
