In furtherance of the earlier order dated 4 September 2021, learned APP, on the basis of the instructions from the Investigating Officer, state that the IO is not desirous of having custody of the Applicant particularly, when an interim protection is operating in favour of the Applicant since 16 October 2019.

In the wake of the said statement, the order dated 16 October 2019 is made absolute subject to the compliance of Clause No.(ii) of the said order.
