P.C.:- Ms. Shinde, learned APP on instructions from Mr. Manoj Chalke, Police Inspector attached to Kurar Police Station, Mumbai submitted that, after the death of foster father of the Petitioner namely Trimbak Chinkar, the son of Trimbak Chinkar from his first wife, is occupying the suit premises. That, the said Trimbak Chinkar was not the real father of the Petitioner. She further on instructions submitted that, there is no record to the effect that, the Petitioner deposited the key of his residential premises with the Kurar Police Station and the premises was locked by the Police of the said Police Station for the purpose of security or safety. 2) In view of the above, we find that there is no substance in the contention of the Petitioner.

Petition is accordingly dismissed.
