P.C.:- By an Order dated 18th November, 2016, the Applicants were granted interim relief.
In the present case, the Investigating Officer Shri Gulabrao More, has filed affidavit dated 21st June, 2017. Apart from the facts giving rise to the lodgment of the present crime and the progress of investigation mentioned therein, in paragraph No. 40 of the said affidavit, it is stated that a sum of approximately 1/3
ssm 2 Rs.1,84,83,273.8/- is yet to be recovered from the Applicants, which is the alleged amount defalcated by the Applicants. The present matter was heard on earlier occasion and after due deliberation, Mr. Desai the learned counsel for the Applicants, on instructions, made statement that his clients are jointly and severally ready and willing to deposit a sum of Rs. 2.00 crores in the Registry of this Court with a view to prove their bonafide and without prejudice to their rights and contentions.
Mr. Desai, today tendered across the bar undertakings executed by the Applicants thereby, giving schedule of deposit of the said amount of Rs.2.00 crores in the Registry of this Court. The Applicants have given undertakings that, in case of any default of payment of the said amount, the Anticipatory Bail granted to the Applicants shall stand forthwith cancelled for noncompliance of the said undertakings. The said undertakings are taken on record and marked "X" for identification.
The Applicants are directed to deposit the said amount as mentioned in the said undertakings in the Registry of this Court, as per the dates specified therein.

ssm 3 In view of the said undertakings, the Applicants are granted pre-arrest bail on the following terms and conditions. a) In the event of arrest in CR No. 239 of 2016 registered with M.R.A. Marg Police Station, Mumbai, the Applicants shall be released on bail on their furnishing PR bond of Rs.25,000/- each with one or two separate solvent local sureties in the like amount.
b) The Applicants shall not tamper with the evidence and/or pressurize the prosecution witnesses.
