Heard the learned counsel for the parties.

By a detailed order dated 12 January 2022, the Applicant was granted interim protection from arrest, in connection with investigation of Crime No.132/2021 of Police Station Nhava-Sheva, Navi Mumbai, under Section 498-A, 504, 506 and 323 r/w. 34 of IPC. The Applicant happens to be the husband of the Complainant Vrushali Kadu.

Learned APP, on instructions from the Investigating Officer, states that the Applicant had reported to the Investigating Officer Mamta Kale page 1 of 2
27-aba-3159-2021 and cooperated with the Investigating Agency. He states that only golden ornament / stridhan of the first informant which is in possession of the Applicant is to be recovered. 4.
Learned counsel for the Applicant states that the golden ornament worth 80 gms of the first informant is with the Applicant which has been pledged to Myra Jewellers for obtaining a temporary financial assistance of Rs.2,20,000/-. The learned counsel for the Applicant, on instructions, states that the Applicant shall produce the said gold ornament before the Investigating Officer within one week. The statement so made is accepted.

In such circumstances, the Criminal Application is disposed of in terms of the order dated 12 January 2022 on the condition that the Applicant shall produce the golden ornament worth 80 gms belonging to the first informant, before the Investigating Officer, within one week from today. If the golden ornament is not produced, this order shall stand vacated without reference to the Court. The Criminal Application is disposed of, in the aforesaid terms.
