Heard the learned Counsel for the respective parties. 2.

After advancing arguments for some time, learned Counsel for the Petitioner seeks liberty to withdraw the Contempt Petition since the Petitioner has already filed S. C. Suit No.217 of 2017 in the City Civil Court at Dindoshi, Mumbai.

We make it clear that the parties are at liberty to seek enforcement of their rights and obligations. We have not decided any issues that arise for consideration in the Contempt Petition and we permit withdrawal of the same in view of the above. 4.

Rights and contentions of both the parties shall be decided by the learned Judge of the City Civil Court strictly in accordance with law.

In view of the aforesaid, the Contempt Petition stands disposed of as withdrawn.
