By an order dated 01.11.2017, the Applicant was granted interim relief.

Perused the record of investigation. The record indicates that the father of first informant in the present crime namely Vinayak Somnath Wayal had earlier lodged first information report in C.R.NO. 196 of 2016 dated 13.07.2016 against the Applicant and other accused persons under Sections 143, 341, 323, 504 & 506 of the Indian Penal Code. The present crime is, thereafter, registered on 03.10.2017 on the basis of report lodged by Ashwini Wayal, the daughter of first informant in C. R .No. 196 of 2016 alleging that the Applicant has outraged her modesty. The record indicates that in pursuance of directions issued by

ABA 1897-17.doc this Court on 01.11.2017, the Applicant has attended the investigating officer and has joined the process of investigation. After perusing the record of investigation, this Court is of the view that, for the purpose of further investigation, custodial interrogation of the Applicant is not necessary.

In view of the above, interim order dated 01.11.2017 is hereby confirmed. Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
