Mr. Saste, learned APP, on instruction from the officer concerned, who is present in the Court, makes a statement that order passed in exercise of power under section 6A of the Essential Commodities Act, 1955, being the order dated 20th July 2018 made by the Controller of Rationing and Director of Civil Supply, Mumbai would be complied with by tomorrow and barge and waste/used petroleum hydrocarbon oil would be released to the Petitioners on their executing indemnity bond. Statement accepted as an undertaking to this Court.

In the light of statement made on behalf of the State, Mr. Kadam, the learned counsel for the Petitioner fairly concedes that patilsr 1 / 2

grievance raised in the writ petition regarding possession of barge and said oil no more survives. He accordingly seeks leave to withdraw the writ petition with liberty to avail appropriate remedy for compensation and damages. Leave with liberty as prayed for is granted. Petition is disposed of.
