This is an application for pre-arrest bail in respect of the offence punishable under Section 408 read with 34 of the Indian Penal Code in connection with First Information Report No.0166 of 2022 registered with Narpoli Police Station on March 23, 2022.

The applicant was served with the notice under Section 41A of the Code of Criminal Procedure (hereafter 'the Cr.PC' for short) on August 17, 2022. Instead of responding to the notice, the applicant approached the Sessions Court for pre-arrest bail.

Learned counsel for the applicant submits that the present applicant will appear before the Investigating Officer in response to the notice under Section 41A of the Cr.PC.

The applicant to report to the Investigating Officer on 26th, 27th and 28th November, 2022, between 11.00 a.m. to 1.00 p.m. and thereafter, as and when called. 5.

After following the procedure, in case the Investigating Officer is satisfied that the applicant needs to be arrested and his custodial interrogation is necessary, 72 hours notice will be given to the applicant.
