Heard learned counsel for the Applicant and learned APP for the State.

Applicant, 36 year old women and her husband, are accused in Crime No. 427/2022 registered with Wanawadi Police Station, Pune for the offences punishable under Sections 326, 324, 504, 506 r/w. 34 of the Indian Penal Code. Complainant is brother-in-law of the applicant. He was allegedly assaulted by Applicant and her husband.

Tikam 2/2 9-ABA-3159-2022 Complainant had sustained four simple and one grievous injuries. The material in the charge-sheet indicates, the applicant-husband allegedly assaulted his brother with a screwdriver. Her husband was arrested and has been granted bail. Thus, in view of role attributed to the applicant, case is made out for granting her pre-arrest protection. Thus, the following order:

ORDER

(i) In the event of arrest of the Applicant in Crime No. 427 of 2022 registered with Wanawadi Police Station, Dist. Pune, under Sections 326, 324, 504 and 506 of IPC, she shall be released on bail on execution of P.R Bond in the sum of Rs.15,000/-, with one or more sureties in the like amount. (ii) The Applicant shall report to the investigating officer , as when when called.

(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case (iv) Application is allowed and disposed of accordingly. It is made clear that observations made here-in-above be construed as expression of opinion for the purpose of bail only and the same shall not in any way influence the trial in other proceedings.
