Learned counsel for the appellant state that she has been instructed to withdraw the L.C.Suit No.2846/2021 in which the Notice of Motion no.3014/2021 came to be filed and on it's rejection, the present Appeal has been instituted. On instructions, she state that the Suit is likely to be withdrawn Tilak

2/2 39 ao 24-22.doc during the course of the day. Necessarily, the present Appeal challenging the order dated 23/12/2021 passed on the Notice of Motion filed in the said Suit do not survive and she seek permission to withdraw the AO.

The aforesaid statement is accepted.
