After arguing for some time, when the Court was not inclined to entertain the aforesaid petition, learned counsel for the petitioner sought leave to withdraw this petition.

Petition is accordingly dismissed as withdrawn. However, the time to comply with Clause - 'a' of the impugned order dated 28th October 2021, passed by the learned Additional Sessions Judge, Greater Mumbai, in Misc. Application No.1052 of 2021, is extended by a period of 30 days N. S. Chitnis 1/2

Needless to state, that the petitioner shall also comply with Clause - 'b' of the impugned order dated 28th October 2021, which reads thus:- "b) Further the applicant shall regularly continue to deposit Rs.4,000/- per month before the trial court until the final decision of the appeal."

If the order is not complied with, appropriate steps be taken by the trial Court.
