The applicant is apprehending his arrest in C.R.No.845 of 2022, registered on 12/08/2022 with Shivaji Nagar Police Station. The subject C.R. invoke Sections 307, 324, 323, 504, 506(2) read with Section 34 of IPC.

In the charge-sheet fled by the prosecution on completion of investigation, accused No.1 is shown to be in custody, whereas accused No.2-Asgar Ali is released on anticipatory bail by the High Court. The present applicant i.e. accused No.3 is shown as absconding alongwith accused No.4.

Learned A.P.P., on instructions of the Investigating Offcer, states that the role attributed to all the accused persons is now crystallized through the charge-sheet and the applicant, who was absconding, has also been attributed a specifc role, though this statement is denied by the learned counsel Ms.Awasthi.

In any case, learned A.P.P. on instructions of the Investigating Offcer who is present in the Court, states that the custodial interrogation of the applicant is not necessary, but he shall render his co-operation to the Investigating Offcer so that he can fle the charge-sheet against him. Accepting the aforesaid statement, the following order is passed.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.845 of 2022 registered with Shivaji Nagar Police Station, applicant-Saddam Ali Ahmed Quriesh shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount. (c) The applicant shall report to the concerned police station on Wednesday and Thursday between 4.00

3/3 17 ABA-3146-22.doc p.m. to 5.00 p.m. for a period of two weeks and, thereafter, as and when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.
