An objection is raised by the learned counsel for respondent No.2 that the impugned order which is challenged by this petition passed by the learned District Judge, Pune, is in an appeal filed under Section 28 of the Hindu Marriage Act and the same is not maintainable before this Court.

In my opinion, the petition is wrongly registered under the Criminal Appellate Jurisdiction and the same is allowed to be converted and registered as a Writ Petition on the Appellate Side under the Civil Appellate Jurisdiction. 3.
