Learned counsel for the applicant/original accused - Sangeeta Sonawane as well as learned counsel for respondent no.2/original complainant - Jaymala Angre are present. Both the counsel as well as parties who are present in the Court had settled the dispute amicably, and had already placed on record consent terms on 22nd June 2016 vide which the dispute between the parties is settled in terms of said consent terms.

As per the consent terms, applicant had made payment of Rs.4,00,000/- to respondent no.2 - complainant. Said payment is made by way of respondent no.2 withdrawing amount of Rs.63,000/- from the Metropolitan Magistrate's Court at Kurla, Rs.1,00,000/- deposited in this Court and balance amount of Rs.2,37,000/- is directly paid by applicant to respondent no.2 in the Court today by demand draft.

In view of fact as aforesaid, as the dispute is amicably settled between the parties, Criminal Appeal stands disposed off as dismissed in terms of settlement on record. In that view of the matter, conviction imposed upon accused by the learned Metropolitan Magistrate's Court in C.C.No.910/SS/2012 dated 21st December 2013 as well as Appeal preferred against judgment and order of the learned trial Court stands set aside. Needless to say that in view of order dated 22nd June 2016 of this Court, respondent no.2 complainant - Jaymala is allowed to withdraw amount of Rs.63,000/- which is deposited with the learned Metropolitan Magistrate's Court at Kurla.
