Heard learned counsel for the parties. The learned counsel for the Respondent No.1 points out that the impugned order is passed on 17 September 2016 and the suit is at such a stage that even oral arguments of Respondent No.1 i.e. Plaintiff are over and the matter is kept on 20 December 2016 for arguments of the Petitioner. At such a belated stage I am not inclined to examine correctness of a purely interlocutory order. The challenge raised by the Petitioner in this petition is kept open to be urged in appellate proceedings, if necessary. Writ Petition is accordingly disposed of. (N.M.Jamdar, J.)
