The petitioner is challenging the order of exterment passed under Section 56 of the Maharashtra Police Act, 1951. The petitioner has remedy of statutory appeal to challenge the order. The petition is therefore dismissed with liberty to the petitioner to file statutory appeal.

It is made clear that the time spent in prosecuting this Petition shall be excluded from the period of limitation, in case the petitioner files an appeal along with application for condonation of delay.

The Writ Petition, therefore, stands disposed of in above terms. No costs.
