CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.1720 OF 2015 Vimal Jadhavji Barot ..Applicant.

Vs.

The State of Maharashtra & Anr.

..Respondents ----- Mr. Balwant V. Salunkhe i/b Subhash Hulyalkar for Applicant. Ms. Rutuja Ambekar, APP for the State.

----- CORAM: A.S. GADKARI, J.

DATE : 17th November 2015.

P.C.

This is an application filed by the applicant for transit bail. The first information report bearing no.97 of 2014 has been registered at Lajpal Nagar police station, New Delhi and with a view to avail and/or exhaust the legal remedies, the applicant is seeking transit bail to approach the competent Court at Delhi.

The applicant on earlier occasion had approached this Court for same and similar relief when this Court by its order dated 27.7.2015 was pleased to grant the same for a period of three weeks. As per the pleadings in para no.4 of the applicant itself, the applicant is in jail as of today in another crime and unless and until he comes out of the jail, grant

2/2 aba.1720-2015 of any relief in favour of the applicant is of no avail to him. The record further discloses that the applicant had move a subsequent application bearing no.1615 of 2015 which came to be dismissed as withdrawn by order dated 27.10.2015. In the circumstances, I am of the opinion that the present application is misconceived and is not tenable in law.

The Application is dismissed.
