The Applicant is admitted to interim-protection by this court by order dated 18/10/2019 in offences punishable under Sections 376(2)(n), 406 and 420 of the IPC. The Court recorded the submission of learned counsel for the Applicant that the prosecutrix is aged 48 years whereas, the Applicant is aged 45 years and the relationship between them is consensual in nature. 3.

When the complaint is perused, prima facie, it can be seen that the relationship was established between two adults. As far as the allegation qua the issuance of cheque to the tune of Rs.20 lakhs in the name of uncle of the Applicant Ashok Mohanani is concerned, the Complainant herself has stated that she has stopped the payment.

In the light of the aforesaid circumstances, since the investigation is complete and the Applicant has co-operated with the investigation, order dated 18/10/2019 is made absolute. The Applicant is, however, expected to render all his assistance to the Investigating Officer in completing the investigation. 5.

The Anticipatory Bail Application as well as the Interim Application are disposed of.
