The petitioners advocate has filed a praecipe stating therein that during the pendency of this petition the petitioners had applied for compounding of the offences under the Direct Tax Laws as One-Time measure before the learned Chief Commissioner of Income Tax and that the learned Chief Commissioner of Income Tax-2, Mumbai, vide order dated 21st October, 2020 had allowed the compounding application filed by the petitioners. It is further stated in the praecipe that pursuant to the said order dated 21st October, 2020, the respondent No.2 - Assistant Commissioner of Income Tax-LTU-1 filed a withdrawal application before the Loknayalay for withdrawal of the criminal case being Criminal Case No.SW/137/2017

2/2 18-wp.5352.2019.doc and that the said application was allowed by the learned Magistrate vide order dated 12th December, 2020 and the case was disposed of. It is stated that in view of the aforesaid development, this petition has become infructuous as the proceedings challenged in the said petition has already been disposed of.

In view of the aforesaid development, the petitioners seeks withdrawal of the aforesaid petition.

Petition is accordingly disposed of as withdrawn. REVATI MOHITE DERE, J.
