The learned APP, on instructions, submitted that in pursuance of order dated 21/11/2015, the applicant attended the Investigating Officer and has co-operated in the process of investigation. She further, on instructions, submitted that the custodial interrogation of the applicant is not necessary. However, the applicant may be directed to attend the Investigating Officer for the purpose of investigation till filing of the charge-sheet. In view of above, following order.

i) The interim relief granted by order dated 17/11/2015 is hereby confirmed.

ii) The applicant is directed to attend the Investigating Officer as and when called for between 11.00 a.m. to 1.00 p.m. till the filing of the charge-sheet. It is needless to mention that before 1/2

15. aba 1721.15.doc calling the applicant to the police station, the Investigating Officer shall issue a notice under Section 160 of Cr.P.C. to the applicant.

iii) By order dated 17/11/2015, the applicant was directed to deposit his passport with the Investigating Officer. Liberty is granted to the applicant to file an application for return of the said passport before the Trial Court.
