This Writ Petition is moved before this Court, as the learned Metropolitan Magistrate, 63rd Court, Andheri, pursuant to the issuance of non-bailable warrant, has taken this applicant/accused in custody, who is facing charges under section 138 of Negotiable Instruments Act. The learned Magistrate has observed that he don't think it proper to consider the Bail Application without hearing the complainant.

I am informed that the Application for bail is fixed for hearing on 11th October, 2018. The learned Magistrate is directed to hear
