This is an application by the applicant/convicted accused for suspension of sentence and to release him on bail during pendency of the appeal filed by him, on such terms and conditions which this court deems it fit. Apart from merits of the matter, which is reiterated in the body of the application and more particularly, from paragraph 16 onwards, the applicant/accused avk 1/3
has pleaded that he has undergone surgeries on his left leg and his third and fourth toe of left leg was amputated. The applicant/accused contended that he was discharged on 25th July 2017 from the hospital and was again re-admitted. The applicant/accused contended that he was granted bail on medical ground and was released on 14th July 2017 and thereafter was admitted to the hospital.
Along with the application, the applicant/accused has annexed the order dated 11th July 2017 passed in Criminal Application No.898 of 2017 filed by him for temporary bail. Perusal of the order passed by this court on 11th July 2017 in Criminal Application No.898 of 2017 (Coram : Revati MohiteDere, J.) shows that the said application was for temporary bail for a period of four months and the same was granted. It is seen that thereafter, the present application came to be filed again on merits of the matter as well as on medical ground. Vide order dated 30th November 2017, this court avk 2/3
(Coram : Anuja Prabhudessai, J.) was pleased to extend the temporary bail granted on 11th July 2017 vide order on Criminal Application No.898 of 2017 till the next date of hearing. Today, the learned advocate for the applicant/accused submitted that the temporary bail as granted vide order dated 10th November 2017 in this application may be extended for a period of one month and then the applicant/accused will surrender himself before the Jail Authorities. The statement so made is accepted. Temporary bail granted to the applicant/accused vide order dated 11th July 2017 passed in Criminal Application No.898 of 2017 and continued vide orders dated 10th November 2017 as well as 30th November 2017 in this application, is further extended for a period of one month from today, with a direction that on expiry of the period of one month, the applicant/accused shall surrender himself before the Prison Authorities.
