by SAYALI DEEPAK UPASANI Date: 2024.04.05 10:56:55 +0530 DATED:- 3rd APRIL, 2024 PC:- 1) Heard Mr. Narvekar, the learned Counsel, who is appointed to espouse the cause of the applicant. 2) This application is preferred through jail, seeking permission to furnish cash security in lieu of surety in terms of the order dated 18th August, 2022, passed by this Court, whereby the applicant was ordered to be released on bail on furnishing a P.R. bond of Rs.25,000/- with one or more sureties in the like amount.

8-BA-3162-23.DOC 3) The applicant has been in custody since 4th April, 2021. It seems the applicant could not furnish surety in terms of the order dated 18th August, 2022 and continues to languish in prison.

4) Having regard to the period of incarceration and especially since the bail order, I am inclined to allow the application and permit the applicant to furnish cash security in lieu of surety for a period of eight weeks from the date of his release from prison.

5) Hence, the following order.

ORDER

I) The application stands allowed.

II) The applicant is permitted to furnish cash security in lieu of surety for a period of eight weeks from the date of his release from prison.

II) The application stands disposed.
