Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 143, 147, 148, 149, 323, 324, 326, 427, 452, 504, 506, 307 of the Indian Penal Code, 1860 and under Sections 4 and 25 of the Arms Act in connection with C.R. No.77 of 2022 dated 26/05/2022 registered with Pangari Police Station, Solapur. 3.

The FIR is dated 26/05/2022. The date of the incident is 24/05/2022. It is alleged that 10 accused assaulted the 1/3

witness Sagar Chapale. The injuries suffered are simple in nature. There is hardly any role assigned to the present applicant. The injuries suffered by Sagar Chapale is simple in nature. There are cross FIRs as even the FIR has been filed from the side of the present applicant. The applicant won the Co-operative Society election and therefore there is some friction between the applicant's group and the group of the complainant. Considering the nature of the accusations and the alleged role of the applicant, so far as the applicant is concerned, the custodial interrogation of the applicant is not required.

Hence, the following order :-

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.77 of 2022 registered with Pangari Police Station, Solapur, the applicant-Maruti Bhagwat Chapale shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the concerned police station on 20/01/2023 and 21/01/2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called. 2/3

(d) The applicant to co-operate with the Investigating Officer.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police OfÏcer and shall not tamper with eiÞidence.

(f) The applicant shall furnish the details of his residential address and phone number to the investigating officer.
