Heard learned counsel for the petitioner and learned APP for the State.

Mrs. Deshmukh, learned APP, on instructions, submits that the report from Vigilance and Quality Control Circle, Mumbai Region, shows that the sample discloses that the contents of the said truck/tanker was readymix.

In that view of the matter, provisions under Mines and Minerals Act, have no application.

Moreover, this petition is also worked out as in pursuance of orders of this Court, contents of the said truck/tanker, the truck and driving 1/2
