Mr. Mohite, learned counsel for the Petitioner, on instructions, seeks leave to withdraw the writ petition with liberty to file application for discharge before the Sessions Court as chargesheet is already filed and case is now committed for trial to the Sessions Court. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. 2.
It is made clear that this Court has not at all gone into merits of the matter and all points and contentions of the respective parties are kept open.

If any application seeking discharge from the proceeding / case is filed by the Petitioner before Sessions Judge, he shall deal with the same in accordance with law and decide it as expeditiously as possible and preferably within the period of six months from the date of such application.
