This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicants came to be arrested in Crime No.243 of 2022 registered at Navin Panvel Police Station, Navi Mumbai for the ofences punishable under Sections 143, 147, 149, 307, 324, 323, 504, 506 of the Indian Penal Code (IPC) and Section 37(1) read with 135 of the Bombay Police Act 1951.

It is the case of the prosecution that on 15 October 2022 at about 6:00 p.m., the present applicants and other co-accused came to the house of complainant and assaulted him by knife. 4.

I have heard the learned counsel for the applicants and the learned APP for the respondent - State and perused the FIR. Dinesh S. Sherla 1/2

The applicant Nos.1 and 3 are real sisters of the complainant. The applicant No.2 is the daughter of the applicant No.1. The learned counsel for the applicants submits that the applicants are in jail for more than one and half months. He submits that false allegations are made due to family dispute. 6.

The motive for alleged assault is attributed to the brother of the complainant. The applicants are in jail for more than one and half months. Considering the facts and circumstances, I am inclined to release the applicants on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicants be released on bail in Crime No.243 of 2022 registered at Navin Panvel Police Station, Navi Mumbai for the ofences punishable under Sections 143, 147, 149, 307, 324, 323, 504, 506 of the IPC and Section 37(1) read with 135 of the Bombay Police Act 1951 on furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) each with one or two sureties in the like amount. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
