This is an application under Section 439 of the Cr.P.C. for bail in CR No.I-89/2018 dated 19.5.2018 registered with Chandwad Police Station, District Nashik under Sections 399 and 402 of the Indian Penal Code.

Heard the learned counsel for the applicant and the learned APP. Page-1/3

Perused the charge sheet.

The learned counsel for the applicant submitted that, co-accused Shaikh Saeed Shaikh Majeed who has been attributed with same and/or similar role has been released on bail by this Court by its Order dated 21.9.2018 in B.A No.2297/2018 and therefore, the applicant may be released on bail on the ground of parity.

The learned APP. fairly conceded to the said fact situation. 4.

After perusing the record, this Court is of the view that, the applicant is similarly situated and has been attributed with same and/or similar role as has been played by co-accused Shaikh Saeed Shaikh Majeed and therefore, the applicant is entitled to be released on bail on the ground of parity.

Hence, the following order.

a) The applicant who is arrested in CR No. I-89 of 2018 registered with Chandwad Police Station, Nashik be released on bail on his furnishing bail bond of Rs.30,000/- with one or two solvent local sureties Page-2/3

in the like amount to the satisfaction of the learned Additional Sessions Judge, Niphad, Nashik.

b) The applicant shall report to the Investigating OfÏcer/Senior P.I. Chandwad Police Station,Nashik, on every first Monday of month until further orders.

c) The applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating ofÏcer and in the bail bond.

d) The applicant shall not change his residential address without prior intimation to the Investigation OfÏcer.

e) The applicant shall not interfere with witnesses or tamper with the evidence in any manner.
