The Applicant is seeking pre-arrest bail in Crime No. 678 of 2016 for the offences punishable under Sections 420, 465, 466, 468 and 504 of the Indian Penal Code registered with the non-applicant. The learned counsel for the applicant submits that the differences between the complainant and applicant are out of the money lending transaction and the applicant is falsely implicated. Perused the contents of the F.I.R., the order passed by the learned Sessions Judge rejecting the bail application and other material available on record.
Prima facie what could be gathered from the material available on record is the applicant is involved in an serious offence particularly in Waghmare 1/2
902.ABA.1976.16.doc relation to the academic discipline as the applicant has promised the complainant to provide with a fake degree of LLB. for consideration. There appears to be sufficient material on the record so as to infer the transactions i.e. the amount that was accepted by the present applicant from the complainant and return thereof by cheque. In view thereof no case for bail is made out. The application is rejected.
