Pursuant to the order dated 15th January 2016, the learned APP has taken instructions in the matter. She states that the arguments of the prosecution in the matter have already commenced. That this is so, is not disputed by Mr.Pasbola, learned counsel for the applicant. The learned APP submits a report clearly stating that the prosecution does not wish to start the trial afresh after joining the original accused no.1 - Amol Jagtap. Anyway, since the arguments have already commenced, the apprehension of the applicant that the trial would be further delayed, can no longer be reasonably entertained. In this view of the matter, Mr.Pasbola seeks permission to withdraw the matter. He however submits that appropriate directions be

Application is allowed to be withdrawn and stands dismissed as such.

The trial Court shall dispose of the case expeditiously and complete the trial by delivering a judgment within a period of two months from today.
