Heard Mr.Agrawal, learned Counsel for petitioners and Mr.Pitale, learned Counsel for respondent.

Mr. Agrawal states that petitioner No.1 is present in the Court. Petitioner No.1 is a practising Advocate. Upon taking instructions from him, he seeks permission to withdraw the Petition. He further submitted that petitioners have also filed affidavit of evidence. He therefore, submitted that the learned trial Judge may be directed to dispose of the Suit in a time bound manner.

On the motion made by Mr. Agrawal, Petition is allowed to be withdrawn and is dismissed as withdrawn. Petitioners are at liberty to file application for disposing of the Suit in a time bound manner. If such application is made, the learned trial Judge will pass appropriate orders after hearing both the sides. Order accordingly. Interim order stands vacated.
