1) Heard. This is an application under section 439 of Code of Criminal Procedure, 1973. Applicant herein is arrested on 08/04/2016 in crime no. 91 of 2016 registered at Charkop Police Station on 01/04/2016. Investigation is completed and charge-sheet is filed against the present applicant for offence punishable under sections 397, 341, 342, 452, 506 (2) of the Indian Penal Code and under Section 37 and 135 of the Bombay Police Act. 2) It is the case of the prosecution that on 01/04/2016, Anand Bondre lodged a report at the police station that he had returned from Nagpur on 01/04/2016. He was accompanied by his friend Pinki. They entered into the
2 35.2272.16 ba apartment. At that time, two unknown persons had entered into the house. She raised hue and cry. That the said persons had tied both of them to a chair and they had committed robbery in the said house. There was a demand of Rs. 1 Crore. The said persons had threatened the first informant and his friend of dire consequences. The person who was threatening had kept his face open. He had brandished his knife. They had robbed the first informant of Rs. 53,000/- and had taken away golden ornaments of his friend. 3) In the course of investigation on the basis of reliable information, present applicant was arrested. In the course of investigation, there was recovery of property worth more than Rs. 3 Lakh which was comprising of golden chain and diamond rings.
On the basis of the recovery of the said valuables, the involvement of the applicant is writ large. It appears that coaccused Vinod and Vinayak have been enlarged on bail by the Sessions Court on the ground that the role attributed to them was that they had shown the house of the first informant. The compilation of the charge-sheet would indicate that there is more than sufficient incriminating material against present applicant which would clearly indicate his involvement in the present case.
