Apprehending that on the basis of the notice dated 4.11.2016 at Exh."O", the scheduled Tribe Certificate Scrutiny Committee, Nashik Division Nashik may proceed with the matter in contravention of the directions contained in para 7 of the order dated 20.7.2016 passed in WP No.6078 of 2016, the petitioner has filed this petition under Article 226 of the Constitution of India. The apprehension of the petitioner is that the Committee may not decide the complaint received by it and may proceed in the matter as if the petitioner as applicant is seeking caste validation

Having heard learned counsel for the petitioner, we are of the view that the apprehension of the petitioner at this stage cannot be accepted. It is open for the petitioner to appear before the Committee and make his submissions keeping in view the directions contained in the order dated 20.7.2016 passed in WP No. 6078 of 2016.

With the aforesaid observations, we dispose of this petition. Needless to say that the Committee shall examine the order passed by this court and shall proceed with the matter in accordance with the directions contained in the said order and in accordance with the law.
