After the matter is heard at some length, it is agreed between learned Counsel for the parties that the impugned order dated 26 March 2019 may be quashed and set aside and the reference be remanded to the Labour Court for a fresh hearing in accordance with law. Accordingly, the order dated 26 March 2019 is quashed and set aside and Reference (IDA) No.185 of 2009 is remitted to the Labour Court for a fresh hearing in accordance with law. The Labour Court is requested to dispose of the reference expeditiously. The Labour Court shall permit the Petitioner (original first party) to lead evidence.
