Ms Monica Amarnath .. Respondent Ms Krupali H. Rajani for the Petitioner.
CORAM :
M. S. SONAK, J.
DATE : 27 NOVEMBER 2015.
P.C. :- 1] Not on board. Upon production, taken on board. 2] There is no case made out to interfere with the impugned order. The Family Court has, in exercise of discretion and in view of certain changed circumstances, permitted the Respondent to file additional affidavit in lieu of examination in chief. There is no jurisdictional error in making of the impugned order. 3] The learned counsel for the Petitioner, however, submits that the original petition, i.e., Marriage Petition, is of the year 2007 and the Respondent is only trying to delay the matter. Without going into the merits of such allegations, but considering that the petition is of the year 2007, the Family Court is directed to dispose of the Marriage Petition P.A. No. 995 of 2007, as expeditiously as possible and in any case, within a period of six months from today. 1/2
DSS p-17-wp-11717-15 4] With the aforesaid observations, the petition is disposed of. There shall be no order as to costs.
