Applicant was granted bail by the Sessions Court vide order dated 3rd July, 2018, on a condition that the applicant shall deposit an amount of Rs.5,19,597/- in two installments. He was directed to deposit 50% of the aforesaid amount on or before 15 days from the date of his resale and rest of the amount within 15 days. It was further directed that in case of default in payment of first installment within 15 days, the bail shall automatically stand cancelled without reference to the Court. Learned counsel for the

rpa 2/2 965-appp-1244-18.doc applicant submitted that 50% amount as stated in the order dated 3rd July, 2018, has been deposited by the applicant. However, the balance amount could not be deposited. This Court by order dated 21st September, 2018, passed in Criminal Application No.435 of 2018, directed the applicant to deposit Rs.1,00,000/- before the trial Court on or before 26th September, 2018 and balance amount of Rs.1,60,000/- on or before 10th October, 2018. However, the order dated 21st September, 2018 is also not complied with. It is submitted that the applicant is in financial constraints, and he needs four weeks time to deposit the amount. The applicant has also not furnished the proof of his residential address and telephone number to the investigating officer, while granting bail by this Court. In the aforesaid circumstances, no case for grant of relief is made out. Criminal Application No.1244 of 2018, is rejected.
