Heard Mr. Suresh Sabrad, learned counsel for the petitioner and Mr. Umesh Mankapure, learned counsel for the respondents. 2.

The matter was heard on 6.12.2016 when Mr. Sabrad tendered communication dated 5.12.2016 addressed by the petitioner to him. The same was taken on record and marked 'X" for identification. Mr. Sabrad also made statement that the petitioner will hand over vacant and peaceful possession of the suit property to the respondents on or before 16.12.2016. 3.

Mr. Sabrad states that the petitioner has handed over possession of the suit property to the respondent on 16.12.2016. Mr. Mankapure confirms receiving possession of the suit property. In view thereof, on the Motion made by Mr. Sabrad, Petition is allowed to be withdrawn and is dismissed as withdrawn. Order accordingly.
