After arguing for some time, both the counsel filed minutes of order dated 29.11.2018. Same is taken on record and marked 'X' for identification which reads thus:

" MINUTES OF ORDER 1] The Orders dated 20/04/2018 and 25/09/2018 passed by the Hon'ble City Civil Court in Suit No.8506 of 1992 are set aside by consent of the parties hereto Mohite 1/2

905 wp13210-18.doc subject to the Petitioner (Original Plaintiff) furnishing costs in the sum of Rs.3,000/- (Rupees Three Thousand only) to the Respondent (Original Defendant) within a period of 1 week.

2] The Petitioner to make an application to the trial court under O. XVI Rule 1 of C.P.C. 1908 to seek permission to examine additional witness viz. Shri Arvind Bhatia. The trial court to hear both the parties after giving opportunity to the Respondent to file its reply and dispose of the said application on merits.

3] The Writ Petition is accordingly disposed off." Writ Petition stands disposed of in terms of minutes of order. No order as to costs.
