This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 581 of 2021 registered at Manchar Police Station, Pune for the offences punishable under Sections 376(2)(i), 376(2)(n), 376(2)(j), 506 of Indian Penal Code and Sections 4, 6, 8, 12 of the Protection of Children from Sexual Offences Act, 2012.

According to the prosecution, the present applicant on several occasions committed sexual intercourse with the victim on the pretext that he would be marrying her, though he was aware that she is minor. 5.

I have perused the charge-sheet. It appears that victim and applicant were in love relationship. The applicant is in jail for about 11⁄2 years. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Sunil Shantaram Pawar be released on bail in Crime No. 581 of 2021 registered at Manchar Police Station, Pune for the offences punishable under Sections 376(2)(i), 376(2)(n), 376(2)(j), 506 of Indian Penal Code and Sections 4, 6, 8, 12 of the Protection of Children from Sexual Offences Act, 2012, on furnishing P.R.
