IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.1518 OF 2015 IN APPEAL FROM ORDER (STAMP) NO.31042 OF 2015 Survin Development Corporation ...Applicant V/s.

Ruchir C. Jain & Ors.

...Respondents

Mr.Dipesh Gaonkar for the Applicant.

Mr.Sachin Joshi for the Respondent No.1.

Mr.P.P. Prabhu for the Respondent No.5.

CORAM : R.D. DHANUKA, J.

DATE : 9TH FEBRUARY, 2016.

P.C. :- 1.

By this civil application, the applicant seeks condonation of delay of 31 days in filing the appeal from order. No affidavit in reply has been filed by the respondents.

2.

I have heard the parties. For the reasons recorded in the civil application, the delay of 31 days in filing the appeal from order is condoned. Insofar as prayer clause (b) in the civil application is concerned, learned counsel appearing for the applicant does not press this relief in view of the fact that the applicant has already filed a separate application for the said relief, which is pending. This 1/2

9-caa1518-15 application for condonation of delay is accordingly disposed of. The applicant is directed to remove all the office obligations within two weeks from today.

3.

The applicant would be at liberty to amend the appeal from order so as to enclose all the orders impugned in the appeal memo. The said amendment shall be carried out within two weeks from today and the amended copy of the appeal from order shall be served upon the respondents through their advocates simultaneously. 4.

Place the appeal from order on board for admission on 7th March, 2016.
